2. Engagement Process

Services begin upon written confirmation of a project proposal. Each engagement is governed by a specific Statement of Work (SOW) detailing deliverables, timelines, milestones, and pricing. Changes to scope require written agreement and may result in revised pricing.

3. Payment Terms

Invoices are payable within 14 days of issuance unless otherwise specified. A 40% deposit is required before project commencement. Late payments accrue interest at 3% per month. All prices are quoted in EUR and are exclusive of applicable taxes.

4. Intellectual Property

Upon full payment, all deliverables and associated intellectual property rights transfer to the client. CreativeDigitax retains the right to use anonymized project data for portfolio and case study purposes unless explicitly declined in writing.

5. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination for a period of 24 months.

6. Limitation of Liability

CreativeDigitax's total liability shall not exceed the total fees paid under the relevant SOW. We are not liable for indirect, consequential, or incidental damages, including lost profits or business interruption.

7. Termination

Either party may terminate with 30 days written notice. Upon termination, client pays for all work completed to date. Deliverables produced up to the termination date are delivered to the client upon payment.

8. Governing Law

These terms are governed by French law. Any disputes shall be resolved before the competent courts of Paris, France.

1. Deposit

The initial deposit of 40% of the total project fee is non-refundable once project work has commenced. This covers resource allocation, initial architecture design, and project setup.

2. Milestone-Based Refunds

Payments are structured around project milestones. If a project is terminated after completion of a milestone, no refund is due for that milestone. Refunds may apply for upcoming, unstarted milestones.

3. Client-Initiated Cancellation

If the client cancels before work begins, a full refund of the deposit is issued within 14 days. Cancellation after work begins results in payment for all completed work up to the termination date.

4. Service Dissatisfaction

If the delivered service materially deviates from the agreed SOW, the client must notify CreativeDigitax in writing within 14 days of delivery. We will remediate at no additional cost within 30 days. If remediation is not possible, a partial refund proportional to the deviation will be issued.

5. Force Majeure

In cases of force majeure preventing delivery, both parties agree to negotiate in good faith. Refunds for prepaid work will be assessed based on work completed versus total scope.

6. Processing

Approved refunds are processed within 14 business days to the original payment method. Clients will receive email confirmation when a refund is initiated.

7. Disputes
